The Workplace Safety and Insurance Act (the "Act") is an Ontario law that provides injured workers with a number of benefits when they get hurt on the job. The WSIB administers this program, which has been set up to protect both employers as well as employees from unnecessary financial strain during difficult times due to illness or injury at work.

If you've been injured on the job, you may be wondering what your next steps should be. Worker's compensation paralegals can provide invaluable services to employees who have been injured on the job. They can help employees navigate through the complex worker's compensation system, ensuring they receive the benefits they are entitled to under the Act.

When you're injured on the job, you face many unknowns. Worker's compensation laws can be complex. A worker's compensation paralegal can help you understand your rights and options under the law and can fight for the benefits you deserve.

Worker's compensation paralegals have extensive experience dealing with worker's compensation claims and can help you get the maximum amount of benefits possible. If the WSIB denies your claim or reduces your benefits, a worker's compensation paralegal can help you appeal the decision.

If you've been injured on the job, don't try to navigate the worker's compensation process alone. Contact a worker's compensation paralegal today to get started on your claim. Having the aid of a skilled workers' compensation legal representative is vital. Workers' compensation paralegals are familiar with the system. They can assist you with submitting a claim for benefits and/or defending you in an appeal if necessary. If you've been injured at work, don't wait to contact a workers' compensation legal representative. Time is of the essence and delays can be detrimental to the success of your claim.

The WSIB is a mandated insurance program that gives benefits to employees who are injured or become ill as a result of their job. WSIB claims offer loss of earnings benefits, medical expenses and rehabilitation. It is important to know what eligibility you have given the circumstances of your injury and claim.

If you're injured on the job, you should notify your employer immediately and ensure they complete an Employer's Report of Injury Form 7 which they submit to WSIB. You will need to complete a Worker's Report of Injury Form 6.

Types of Workers’ Compensation Benefits

Ontario has some of the best workers' compensation laws in Canada. If you're injured on the job or lose your loved one due to a workplace accident it is possible for them to receive full financial compensation through legal channels with help from professional Ontario-based legal firms like ECHO Legal Services Professional Corporation who are well experienced in these types of cases. We will fight tirelessly until justice prevails and our clients get what they deserve. Below are a few of the different types of worker's compensation benefits available to injured workers:

  1. Loss of Earnings: The WSIA entitles most workers to recover 85% of their net-average wages for injuries that occurred on or after January 1, 1998 up to an annual maximum. The maximum for 2022 is $100,422. Loss of earnings benefits can be payable from the day after your injury if you lose time from work and can be payable until you are able to return to work. Loss of earnings benefits are not paid beyond age 65.
  2. Health Care Benefits: You may be entitled to recover all WSIB pre-approved health care expenses such as prescription medication, physiotherapy, chiropractic treatment, acupuncture, massage therapy, etc
  3. NEL Benefit Award: You may be entitlement to a NEL Benefit Award if it is determined that you suffered a permanent impairment as a result of your work injury. A NEL Benefit Award is a one-time lump payment for pain and suffering which is paid above and beyond loss of earnings benefits. The WSIB identifies the base amount and age adjustment factor for the year the injured worker reaches Maximum Medical Recovery (MMR).
  4. Rehabilitation Services: If an injured worker is unable to return to his/her regular job, the WSIB offers rehabilitation services to assist in determining a suitable occupation. An injured worker may receive retraining or schooling depending on the need. Full loss of earnings are generally paid during this process provided the injured worker is fully cooperative.
