Types of Workers’ Compensation Benefits

  1. Loss of Earnings: The WSIA entitles most workers to recover 85% of their net-average wages for injuries that occurred on or after January 1, 1998 up to an annual maximum. The maximum for 2022 is $100,422. Loss of earnings benefits can be payable from the day after your injury if you lose time from work and can be payable until you are able to return to work. Loss of earnings benefits are not paid beyond age 65.
  2. Health Care Benefits: You may be entitled to recover all WSIB pre-approved health care expenses such as prescription medication, physiotherapy, chiropractic treatment, acupuncture, massage therapy, etc
  3. NEL Benefit Award: You may be entitlement to a NEL Benefit Award if it is determined that you suffered a permanent impairment as a result of your work injury. A NEL Benefit Award is a one-time lump payment for pain and suffering which is paid above and beyond loss of earnings benefits. The WSIB identifies the base amount and age adjustment factor for the year the injured worker reaches Maximum Medical Recovery (MMR).
  4. Rehabilitation Services: If an injured worker is unable to return to his/her regular job, the WSIB offers rehabilitation services to assist in determining a suitable occupation. An injured worker may receive retraining or schooling depending on the need. Full loss of earnings are generally paid during this process provided the injured worker is fully cooperative.
